Whistler Terms and Conditions

1. Introduction

Welcome to Whistler. These Terms of Service ("Terms") govern your use of the Whistler application, an integrated whistleblowing and compliance management tool provided by Second Path Pte Ltd ("we", "us", "our"). By accessing or using Whistler, you agree to be bound by these Terms.

2. Eligibility and Registration

Whistler is available to organisations of all sizes. The application is accessible globally. By registering for Whistler, you confirm that you are authorised to act on behalf of your organisation and agree to provide accurate registration information.

3. Subscription, Renewal, Cancellation, and Refund

3.1. Subscription Plans

We offer monthly and annual subscription plans. Details of these plans, including pricing and features, are available on our website.

3.2. Renewal

Subscriptions are automatically renewed at the end of each subscription period unless you cancel the subscription.

3.3. Cancellation

You may cancel your subscription at any time. The cancellation will take effect at the end of the current billing cycle.

3.4. Refund Policy

Refunds are not provided for partial subscription periods or for periods where the service was not used.

4. Privacy and Security

Please refer to our separate Privacy Policy and Security Policy for detailed information on how we handle and protect your data.

5. User Responsibilities

Users are expected to ensure that the data uploaded to Whistler relates specifically to the sending, receiving and management of whistleblower reports. Misuse of the service for unrelated purposes is prohibited.

6. Intellectual Property Rights

6.1. Content Ownership

Users retain ownership of the content they create within Whistler. However, currently, there is no feature to export this content. We will never share or use your content.

6.2. Software Ownership

Whistler and all intellectual property rights in the software, including trademarks, are owned by Second Path Pte Ltd.

7. Limitation of Liability

Second Path Pte Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in connection with the use or inability to use Whistler.

8. Termination

If an organisation chooses to close its account, we will delete all associated data, including user data and content, in compliance with our data retention policies.

9. Amendments to the Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website, and the effective date will be updated.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of Singapore. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
